Affidavit reveals gunman fired 'into a crowd' outside Pegasus nightclub

Jose Hernandez, 44, facing three counts of aggravated assault with deadly weapon

SAN ANTONIO – A man charged in the Pegasus nightclub shooting that wounded three people Monday morning was thrown out by security but later returned in a vehicle and fired several shots into a crowd hanging out in front of the club, according to an arrest affidavit.

Witnesses told police that Juan Rincon Hernandez, 44, was kicked out around midnight from Pegasus, located in the 1400 block of North Main Avenue, after he got into an altercation. They said Hernandez left with a man and a woman.

A short time later, witnesses said a vehicle pulled up and that's when Hernandez began firing a handgun from the passenger seat into the crowd, according to the affidavit.

Three people were wounded in the drive-by shooting -- a 41-year-old man, a 32-year-woman and a 30-year-old man -- and suffered injuries that were not life-threatening.

Police at the scene said the altercation started when Hernandez made a racial slur toward a man because he and another man he was with were taking too long at a taco truck parked near Pegasus. The affidavit does not mention that incident.

Police were able to locate Hernandez after a witness provided them his phone number. Another witness later identified Hernandez to detectives as the gunman who he saw pull out a Smith and Wesson .40-caliber handgun to shoot at people, according to the affidavit.

According to the affidavit, police found .40-caliber shell casing at the scene.

Police Chief William McManus said Hernandez turned himself around 2 p.m. Tuesday, and investigators later recovered the weapon used in the shooting.

McManus said the shooting was not a hate crime directed toward the LGBTQ community but rather driven by an individual who was upset for being thrown out.

Hernandez is now facing three counts of aggravated assault with a deadly weapon.
