Driver in fatal crash accused of drunken driving again

Justin Duncan, 30, was arrested on DWI charge Saturday

SAN ANTONIO – A man who was already convicted on a fatal drunken driving charge is again facing charges related to drunken driving.

Justin Duncan, 30, was arrested Saturday night on a charge of DWI with a previous intoxication manslaughter conviction.

Records show San Antonio police arrested him around 8 p.m. in the 300 block of Jackson Street.

Because of the Memorial Day holiday, additional information about the circumstances of his arrest was not available.

However, records show he was booked into the Bexar County jail, and released around 2:30 a.m. Sunday after posting a $15,000 bond.

While a first time DWI arrest is often handled as a misdemeanor, Duncan faces an enhanced charge because of his prior conviction.

It stems from a November 2003 crash in the 1900 block of Babcock Road that killed Mark Johnson, 38, a passenger in his car.

News stories at the time quoted police as saying that Duncan, who was 21 then, had been driving drunk and speeding prior to the crash, and then ran from the scene after it happened.

Records show he was sentenced to 6 years in prison in connection with that case.

This time around, it appears he is free until his trial.

A woman who answered the door at Duncan's listed residence Monday morning, at first, said that he did not live there, then said that he wasn't home.
