A San Antonio woman who was forced to have her legs amputated following an emergency room misdiagnosis has now been ordered to pay the legal fees of the defendants in a lawsuit she filed against her medical providers.
Connie Spears, 56, had her legs amputated above the knee in May 2010.
Among the medical providers she later sued was Christus-Santa Rosa and the South Texas Radiology Group.
On Friday, 407th District Court Judge Karen Pozza ordered that Spears pay over $8,000 in legal fees to the providers she sued.
Pozza explained to Spears that she had no choice but to order payment under Texas laws.
The reason Spears' suit was dropped last year was because she could not prove the providers acted "with willful and wanton negligence" in her case.
The law requires her to do so in order to recover damages.
"I just go back home and I guess try to figure out what we're going to do," Spears said as she left the courtroom.
Attorney Justin Williams, who represented Spears in her lawsuit, said, "She got a terribly bad deal that is going to affect her and her family for the rest of their lives."
Attorneys for Christus-Santa Rosa asked the judge to dismiss them from the case. That request was granted, releasing Spears from any financial obligation to the hospital.
