NEW BRAUNFELS, Texas – A second arrest has been made in the 2013 punching death of Canyon High School student Logan Davidson.
Enrique Ruiz Gonzales, 18, remains in the Comal County Jail under $50,000 bond after being indicted of murder.
An attorney representing the Davidson family had no comment.
Already charged with murder, a 16-year-old classmate of both Davidson and Gonzales is awaiting trial March 9 in juvenile court.
However, Gonzales is not charged with physically causing Davidson's death.
The indictment said Gonzales assisted because he allegedly "solicited, encouraged, aided or attempted to aid in the commission of the crime."
Exactly how is not yet known.
Comal County District Attorney Jennifer Tharp has not commented on the case.
Lt. Craig Christopherson, a New Braunfels Police Department spokesperson, said initially Gonzales was considered a witness.
But after investigating further, Christopherson said police wanted to charge him with aggravated assault, but would not reveal why due to the pending court case.
He said police were unaware Gonzales would be indicted for murder.
"I was surprised, then I was disappointed," said Joseph Garcia III, the attorney representing the 16-year-old defendant in the case.
Garcia had a much different version of Gonzales' alleged actions that day.
"Mr. Gonzales was part of the group that were antagonizing and essentially assaulting our client," Garcia said.
But Garcia said he could not get into the specific details and that he was also was disappointed by the indictment.
He said the hope was his client's case could be resolved without a jury trial.
"This is a signal to me the DA is more interested in fighting this case to the bitter end," Garcia said.
He also said the case has taken an emotional toll on his young client.
"It's not just about him," Garcia said. "He feels badly for the other family. He feels badly at what happened at all."
