SAN ANTONIO – A Bexar County grand jury on Tuesday indicted the man charged in the shooting death of San Antonio police Detective Benjamin Marconi.
Otis McKane was indicted on a capital murder charge in connection with the Nov. 20 slaying, which took place in front of police headquarters.
McKane parked his car behind Marconi's police cruiser, got out of the vehicle and shot the 20-year veteran of the force, according to an arrest affidavit. Marconi was writing a ticket when he was killed.
When McKane was arrested, he said he had been upset about a child custody case when he shot Marconi and was sorry for the assassination.

During a jailhouse interview a few weeks later, McKane said his words were misconstrued and declined to talk about the slaying or any events leading up to it.
Bexar County District Attorney Nico LaHood said that he will try the case himself and review the case before deciding whether to pursue the death penalty.
