SAN ANTONIO – Bexar County Commissioner Kevin Wolff, still on probation as part of a drunken driving plea agreement earlier this year, failed a court-ordered alcohol test, according to records obtained by the KSAT 12 Defenders.

The supplemental report, filed by Wolff's probation officer in County Court 4 Monday, indicates that Wolff skipped 24 alcohol monitoring tests between May 17 and June 17 then later tested positive for alcohol during a urine test in August.
Wolff, who said he has no intention to step down, released the following statement Tuesday afternoon via text message:
I have done everything asked of me and will continue to do so. I have not had a drink nor will I at least until my probation is over and frankly don't intend to ever. This is the life I choose and though it means having anything and everything about me and my personal issues on display, I know that is the price I must pay to live the life I choose.
Wolff blamed the skipped tests on the mobile alcohol monitoring device not functioning properly as he traveled this summer, according to the report.

Wolff denied using alcohol when shown the results of the positive test.
Wolff also tested positive in August for benzodiazepine, an anxiety medication, but had an approved prescription to use the medication, according to Wolff and the report.
He will now be required to continue mobile alcohol monitoring through January 2, 2018.
Wolff was sentenced to one-year probation and alcohol monitoring as part of a plea agreement in March to a reduced charge of driving while intoxicated, following a July 2016 drunken driving accident in the drive-thru of a North Side Whataburger.

Wolff, whose blood-alcohol level was two and a half times the legal limit, originally faced an enhanced charge of DWI.
