According to Live Oak police, the victim went to the gas station to meet someone he was going to sell headphones to.

Police said that’s when Kelly showed up in a ski mask and struck the victim in the face. The victim attempted to flee from Kelly.

According to an arrest affidavit, Kelly then shot the victim in his back.

When Live Oak police arrived, authorities said Kelly already fled the scene and the victim was found at a gas pump.

The victim’s condition remains unknown. However, police said he was alert and speaking when investigators arrived at the scene.

When a Live Oak officer visited the victim at a local hospital, the victim told the officer that he recognized the shooter as Kelly, a former schoolmate.

Four days after the shooting, an unidentified witness reached out to Live Oak police. The witness told police that they drove Kelly to the gas station on Dec. 6, but the witness did not know what Kelly had planned to do once he arrived.

On Dec. 12, Live Oak police met in person with the witness, who confirmed that Kelly shot the victim because he had been looking for the victim due to previous unspecified issues.

Kelly was booked into Bexar County custody on Tuesday where a judge set his bond at $100,000.

Kelly was released on bond on Wednesday afternoon.
